Changes to These Terms
We may update these Terms from time to time. Material changes will be posted here. Your continued use after an update means you accept the revised Terms.
Dispute Resolution; Arbitration Agreement
You and we agree that any dispute, claim, or controversy arising out of or relating to the Service or these Terms (“Dispute”) will be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. The Federal Arbitration Act (9 U.S.C. §§ 1–16) governs this agreement to arbitrate. The seat of arbitration is Connecticut, and the language is English. Either party may bring an individual claim in a court of competent jurisdiction for small-claims matters. Class actions, class arbitrations, and representative proceedings are not permitted.
Opt-Out: You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing support@betsandcars.com with subject “Arbitration Opt-Out” and your email address used on the Service. If a court finds this arbitration agreement unenforceable as to a particular claim, that claim may be litigated only in the courts specified below in Governing Law & Venue.
Governing Law & Venue
These Terms are governed by the laws of the State of Connecticut, excluding its conflict-of-laws rules. If a Dispute must be litigated in court (for example, an eligible small-claims case or if the arbitration agreement is found unenforceable as to a claim), the exclusive venue will be the state courts located in Fairfield County, Connecticut, or the U.S. District Court for the District of Connecticut. To the extent you are a consumer, you retain any non-waivable rights under the laws of your place of residence.
